This website delicatezzeitaliane.com has been created for the selling of typical regional food products to consumers and the trade in compliance with Italian regulations relating to distance contracts.

Sales are governed by these General Conditions and by any conditions described in the products description of this website, which are to be considered as integral and material parts of the sales contract. Customers are therefore requested to read these terms of sale and the information contained herein carefully before sending an order, and to print them out or store them on accessible permanent media.

Any changes to the terms of sale will come into force when they are published on the website and will only apply to orders made following their publication. The sending of an order by a Customer will be considered as acceptance of the terms of sale currently in force at that time.

Rates

The prices applied are as given on the website when the order is submitted by the Customer.
The prices of products are subject to change, in which case the new prices published on the website cancel and replace those given previously.

Characteristics and availability of products In particular circumstances, Delicatezze Italiane S.r.l. may not be able to ensure the availability of all the products. We will undertake furthermore, in accordance with the law, to inform the Customer without delay of any unavailability of ordered products. The Customer will then be free to choose whether to carry on with the order (deprived of unavailable items) or cancel the entire order. The total amount charged will, of course, relate to the final order, i.e. the goods which will actually be delivered.

Shipments to the USA

As from December 2003, due to FDA importation restrictions food and wine products cannot be shipped to consignees in the USA, Canada, Mexico, the Caribbean, Central America or South America.

Warranties and liability

Warranties and liability Within the limits stated above, Delicatezze Italiane S.r.l. guarantees delivery of products of the same contents as those described in the website. Delicatezze Italiane S.r.l. guarantees compliance with all regulations relating to the storage of products until their delivery to the place stated in the order. The producer’s liability applies to all products sold. In the case of packaged products, the producer is also responsible for the truthfulness and completeness of the indications given on the packaging. The pictures shown on the site are provided to facilitate identification of products, and may not be an exact reflection of the exterior appearance of the delivered product in the event of variations being made to the packaging by the producer.

Right Of Withdrawal

Purchases made on-line from the delicatezzeitaliane.com website are governed by Italian law on mail-order sales (art. 5 Decree Law no. 185/99). In the event of an error in the order and/or in the receipt of an article, or in the event of dissatisfaction with a purchase, Customers have 10 working days to exercise their right of withdrawal; in other words to communicate their intention to withdraw from the contract, to return the product, and to be reimbursed.

The request for reimbursement must be communicated in advance by e-mail (customer.service@delicatezzeitaliane.com) and confirmed within 48 hours by registered mail with return receipt requested to the following address:

In accordance with e-business regulations, the Customer will be liable for the cost of the return shipment. In order to exercise the right of withdrawal, goods must be returned within 10 days of their receipt. The return of any article will be accepted without hesitation, providing it is in good condition, and the entire amount paid will be refunded. Products must be packaged carefully before they are returned in order to protect them during transport. By law, the cost of the return shipment is to be borne by the Customer.

Delicatezze Italiane S.r.l. will refund the sum due within 30 days of the receipt of the communication of the decision to withdraw from the contract.

Disputes and applicable law

Any disputes relating to the application, performance and interpretation of the distance sales contract are subject to Italian jurisdiction and will be referred to the Client's place of residence Court if located in Italy. Distance contracts entered into with Delicatezze Italiane S.r.l. are governed by Italian law, and unless otherwise expressly provided for, the relevant laws will apply thereto.
